• The Services are educational and informational only. They do not replace professional medical advice, diagnosis, or treatment.

3. Accounts

• Employers and brokers may receive aggregate or de-identified usage reports for program administration.
• Your personal results are never shared without your explicit, written consent.

8. Third-Party Services

• Omega integrates with laboratories, telehealth providers, and other service providers.
• These third parties are independent and subject to their own terms and policies.
• Omega is not responsible for third-party practices or outcomes.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

OMEGA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

• Omega does not guarantee error-free operation, uninterrupted access, or specific results.
• Wellness recommendations may not apply to every individual and are not medical treatment.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OMEGA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.
• OMEGA’S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID TO OMEGA IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Omega, its affiliates, officers, employees, and contractors against claims, damages, or expenses (including attorney fees) arising from:

• Your use of the Services;
• Violation of these Terms; or
• Violation of applicable laws or third-party rights.

12. Termination

• Omega may suspend or terminate your access to the Services at any time for violation of these Terms or misuse of the Services.
• Upon termination, your right to use the Services ceases immediately.

13. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the State of New York, USA, excluding conflicts of laws principles.
• Any dispute shall be resolved by binding arbitration before the American Arbitration Association (AAA) in New York County, NY.
• Class action waivers: You agree to resolve disputes individually and waive the right to participate in class actions.
• You may opt out of arbitration by emailing legal@omegagenetics.com within 30 days of first use.

14. Changes to Terms

We may update these Terms periodically. Updates will be posted with a new Effective Date. Continued use of the Services after updates constitutes acceptance.
